BON CHEFFY TERMS OF SERVICE

Welcome to Bon Cheffy.

These Terms of Service (“Terms”) govern your access to and use of the Bon Cheffy mobile application, website, software, artificial intelligence features, content, memberships, subscriptions, and related services collectively referred to as the “Services.”

Bon Cheffy is operated by Girtonian LLC, located at 2045 W Grand Ave Ste B #240013, Chicago, IL 60612 (“Bon Cheffy,” “we,” “our,” or “us”).

Please read these Terms and our Privacy Notice carefully before using Bon Cheffy.

By creating an account, accessing the Services, joining the Bon Cheffy Club, purchasing a subscription, uploading content, or otherwise using Bon Cheffy, you agree to these Terms.

If you do not agree, do not use the Services.

1. ABOUT BON CHEFFY

Bon Cheffy is an AI-powered cooking companion designed to help users discover recipes, cook with ingredients they have available, follow guided cooking instructions, interact with an AI kitchen assistant, save recipes and cookbooks, and receive playful critiques of finished meals.

Features may include:

ingredient and refrigerator photo analysis;
AI-generated recipes;
recipe discovery and recommendations;
saved recipes and cookbooks;
personalized recipe suggestions;
guided “Cook with Cheffy” cooking sessions;
timers and cooking reminders;
ingredient substitutions;
recipe scaling;
voice interactions and audio responses;
progress-photo analysis;
meal photo or video uploads;
“Roast Me” meal critiques;
social sharing;
achievements, badges, streaks, and rewards;
community or creator recipes;
Bon Cheffy Club membership features; and
other functionality we may introduce over time.

Some features may use artificial intelligence, computer vision, speech recognition, text-to-speech systems, third-party APIs, or other automated technologies.

We may add, modify, suspend, or discontinue features as Bon Cheffy evolves.

2. WHO MAY USE BON CHEFFY

You must be at least 18 years old, or the age of legal majority where you live, to create an account or use Bon Cheffy independently.

By using the Services, you represent that:

you meet the applicable age requirement;
you have the legal capacity to enter into these Terms;
you are not prohibited from using the Services under applicable law; and
the information you provide to us is accurate and current.

If Bon Cheffy later introduces experiences specifically intended for younger users or families, those experiences may be governed by additional terms and parental-consent requirements.

3. YOUR ACCOUNT

Certain Bon Cheffy features may require an account.

You are responsible for:

maintaining accurate account information;
maintaining the confidentiality of your login credentials;
activity occurring through your account; and
notifying us promptly if you believe your account has been compromised.

You may not impersonate another person or create an account using information you do not have permission to use.

We may suspend or terminate accounts that violate these Terms, create security risks, or are used fraudulently.

4. AI-GENERATED CONTENT

AI is optional and starts off. By selecting “Enable AI features” in the introduction opened from Settings → Privacy & AI or your first AI use, you authorize Bon Cheffy to process and share the information reasonably needed to provide the AI features you use while the AI-powered cooking toggle remains on. This is an ongoing choice for your account on that device, rather than a separate approval for each request. Creating an account, accepting these Terms, or granting device permissions does not by itself enable AI.

This authorization covers related processing within the cooking features you use, including ingredient and photo analysis, recipe generation and imports, substitutions and recipe changes, cooking tips and answers, food roasts, and generated narration. Depending on the feature, the relevant information can include questions, ingredient text, recipe content and cooking steps, imported link content, submitted photos, dietary or allergy preferences you provided, and narration scripts. It does not authorize unrelated collection or use of your information.

Bon Cheffy uses OpenAI for AI cooking responses and image or recipe analysis, ElevenLabs for generated narration, and Supabase for uploads, generated audio, and storage. These services receive the relevant content through Bon Cheffy’s service infrastructure as needed for the feature. You do not need to approve each individual service call while AI is enabled.

You can turn AI off at any time in Settings → Privacy & AI to stop new AI requests from that account on that device. Turning it off does not recall requests already sent or delete previous uploads, recipes, or audio. Saved recipes and their existing instructions remain available without AI. The choice is stored per account on the device and is not synchronized across devices. A changed consent scope or reset local app data may require a new opt-in.

Camera, photo-library, and microphone access remain separate device permissions. Enabling AI does not grant those permissions, start continuous recording, publish content to other users, or authorize generalized model training. See the Privacy Notice for retention, training, and other privacy choices.

Bon Cheffy uses generative artificial intelligence to provide recipes, cooking instructions, recommendations, substitutions, meal critiques, conversational responses, and other content (“AI Output”).

AI Output is generated automatically and may sometimes be:

inaccurate;
incomplete;
inappropriate for your particular circumstances;
inconsistent between requests;
based on incorrect visual identification;
missing an ingredient, allergen, cooking step, or safety consideration; or
similar to content generated for another user.

You should review AI Output before relying on it.

Bon Cheffy does not guarantee that AI Output is accurate, original, complete, safe, nutritionally correct, or suitable for your individual needs.

You remain responsible for decisions you make based on AI Output.

5. IMPORTANT COOKING AND FOOD-SAFETY NOTICE

Bon Cheffy is a cooking assistant. It is not a substitute for professional food-safety guidance.

AI systems may not be able to determine from a photo or video whether food is fully cooked, contaminated, spoiled, or safe to consume.

You should never rely solely on Bon Cheffy, a photograph, a video, or AI-generated feedback to determine whether meat, poultry, seafood, eggs, leftovers, or other potentially hazardous foods are safe to eat.

You are responsible for:

cooking food to appropriate safe temperatures;
using appropriate food thermometers when necessary;
preventing cross-contamination;
storing food safely;
checking expiration and spoilage indicators;
maintaining appropriate kitchen hygiene; and
following applicable food-safety guidance.

If Bon Cheffy’s recommendation conflicts with authoritative food-safety guidance, follow the authoritative guidance.

6. ALLERGIES, DIETARY RESTRICTIONS, AND NUTRITION

Bon Cheffy may provide estimated nutrition information, dietary classifications, ingredient substitutions, or recipes designed around stated preferences.

These features are for general informational purposes only.

Bon Cheffy is not a physician, registered dietitian, allergist, nutritionist, or medical provider.

We do not guarantee that:

a recipe is free from a particular allergen;
an ingredient has been correctly identified;
cross-contamination will not occur;
nutrition calculations are accurate;
a substitution is medically appropriate; or
a recipe is suitable for a health condition.

You are responsible for understanding your own allergies, sensitivities, medical conditions, dietary requirements, and ingredient restrictions.

If you have a severe allergy, medical condition, pregnancy-related dietary concern, or other health issue, consult an appropriate professional before relying on information provided by Bon Cheffy.

Use of Bon Cheffy does not create a physician-patient, dietitian-client, or other professional healthcare relationship.

7. VOICE AND COOKING MODE

Bon Cheffy may offer voice-controlled features, speech recognition, text-to-speech responses, timers, conversational cooking assistance, and other hands-free features.

Voice recognition may misunderstand you, particularly in environments with background noise.

You remain responsible for confirming:

cooking temperatures;
measurements;
timer durations;
ingredient quantities;
appliance settings; and
other safety-critical instructions.

Do not interact with Bon Cheffy in a way that creates an unsafe distraction while handling knives, open flames, boiling liquids, hot oil, electrical appliances, or other kitchen hazards.

8. PHOTOS, VIDEOS, AUDIO, AND OTHER USER CONTENT

The Services may allow you to upload, capture, submit, store, create, or share materials including:

ingredient photos;
refrigerator or pantry photos;
meal photos;
progress photos;
cooking videos;
audio or voice input;
recipes;
recipe descriptions;
comments;
usernames;
profile information; and
other materials.

Collectively, these materials are “User Content.”

You retain ownership of your User Content.

By submitting User Content to Bon Cheffy, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify, transmit, and display that User Content only as reasonably necessary to operate, secure, improve, and provide the Services, including processing it through service providers that help power Bon Cheffy.

Our collection and processing of User Content is also governed by our Privacy Notice.

9. RIGHTS YOU MUST HAVE TO YOUR CONTENT

You may only upload content that you have the right to use.

By submitting User Content, you represent that:

you own the content or have permission to use it;
submitting it does not violate another person's copyright, trademark, privacy, publicity, contractual, or other rights;
anyone identifiable in the content has provided any consent required by law; and
the content does not violate these Terms or applicable law.

You are responsible for your User Content.

Certain Bon Cheffy features may allow you to share:

generated recipes;
recipe cards;
badges;
achievements;
Roast Me results;
meal images;
cooking progress;
profile achievements; or
other content

through social media, messaging apps, links, or other services.

Sharing is optional.

Once you share information outside Bon Cheffy, that information may become publicly available and may be copied, redistributed, downloaded, or used by others beyond our control.

Review content carefully before sharing it publicly.

11. ROAST ME

“Roast Me” is an entertainment feature that generates humorous AI commentary about food, presentation, or cooking technique.

Roast Me is intended to critique the food—not the person who made it.

Roast Me results are generated automatically and may be exaggerated, comedic, or inaccurate.

You may not use Roast Me or any other Bon Cheffy feature to:

bully or harass another person;
target another person based on protected characteristics;
create defamatory content;
humiliate someone without their permission;
encourage abuse;
impersonate another person; or
create unlawful or harmful content.

We may restrict, remove, or refuse to generate Roast Me content that violates these Terms.

12. BON CHEFFY CONTENT AND INTELLECTUAL PROPERTY

The Services, including our:

software;
interfaces;
graphics;
illustrations;
recipes created or commissioned by us;
original written content;
mascot and character designs;
Bon Cheffy name;
Cheffy character;
logos;
icons;
badges;
stickers;
animations;
audio;
voice experiences;
branding;
layouts; and
other proprietary materials

are owned by or licensed to Bon Cheffy and are protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Bon Cheffy for its intended purposes.

This license does not transfer ownership of Bon Cheffy intellectual property to you.

13. AI OUTPUT AND YOUR USE OF IT

Subject to applicable law and third-party rights, you may use recipes, cooking suggestions, Roast Me results, and other AI Output generated for you through Bon Cheffy for personal purposes and may share them using features made available through the Services.

AI systems may generate similar or identical material for multiple users.

Bon Cheffy therefore does not guarantee that AI Output:

is unique;
qualifies for copyright protection;
does not resemble existing material; or
is exclusively yours.

You are responsible for evaluating AI Output before publishing, selling, or commercially exploiting it.

Bon Cheffy does not transfer ownership of its underlying models, software, prompts, branding, templates, interfaces, or proprietary systems through the generation of AI Output.

14. COMMUNITY AND CREATOR RECIPES

Bon Cheffy may allow users, chefs, creators, partners, or brands to upload or publish recipes.

Unless expressly identified as a Bon Cheffy recipe, community recipes are provided by third parties.

We do not guarantee that community recipes are:

accurate;
original;
properly attributed;
safe;
nutritionally correct;
appropriate for allergies; or
tested by Bon Cheffy.

Creators remain responsible for recipes and other materials they submit.

Bon Cheffy may remove or restrict content that violates these Terms.

15. PROHIBITED CONDUCT

You may not use Bon Cheffy to:

violate any law;
infringe intellectual-property rights;
invade another person's privacy;
upload content you do not have permission to use;
harass, threaten, bully, or abuse others;
submit sexually explicit content;
submit exploitative content involving minors;
promote violence or illegal activity;
upload malicious code;
attempt unauthorized access to our systems;
interfere with the operation of the Services;
scrape or systematically extract content without permission;
reverse engineer the Services except where applicable law expressly permits it;
bypass usage restrictions or security measures;
create fraudulent accounts;
manipulate purchases or payment systems;
use automated systems to abuse our Services;
use the Services to develop or train a competing product using Bon Cheffy's proprietary materials without authorization; or
use Bon Cheffy in any manner we reasonably determine threatens users, our systems, or the integrity of the Services.

16. CONTENT MODERATION

We are not required to monitor every item submitted through Bon Cheffy.

However, we may review, block, remove, restrict, or disable access to content or accounts when we reasonably believe doing so is necessary to:

enforce these Terms;
protect users;
investigate fraud or abuse;
protect Bon Cheffy;
respond to reports;
comply with law; or
maintain the quality and safety of the Services.

17. FEEDBACK

We welcome suggestions, comments, ideas, and other feedback about Bon Cheffy.

If you provide feedback, you grant us permission to use it without restriction or compensation to you.

This allows us to incorporate suggestions into current or future Bon Cheffy products and services.

Do not submit confidential information as feedback.

18. BON CHEFFY FREE AND BON CHEFFY CLUB

Bon Cheffy may offer both free and paid membership experiences.

Bon Cheffy Free

Bon Cheffy Free may provide access to selected features, including certain recipes, cookbooks, AI-generated cooking experiences, recipe-saving tools, cooking utilities, and limited use of other AI-powered features.

Free feature availability and usage limits may change as the Services evolve.

Bon Cheffy Club

Bon Cheffy Club is our paid membership experience.

Bon Cheffy Club is designed for people who want more Cheffy in their kitchen and may include enhanced access to features such as:

AI recipe generation;
ingredient and refrigerator analysis;
voice-guided Cook with Cheffy experiences;
conversational cooking assistance;
progress-photo analysis;
personalized recipe recommendations;
enhanced ingredient substitutions;
recipe scaling;
nutrition estimates;
premium or partner cookbook collections;
expanded Roast Me features;
cooking history;
streaks and achievements;
exclusive badges;
personalization features;
community-oriented Club experiences; and
additional member benefits introduced over time.

Specific features included with Bon Cheffy Club will be displayed within the Services.

Membership does not guarantee permanent access to any individual feature. We may improve, replace, add, or modify Club features as Bon Cheffy evolves.

Certain AI-powered features may be subject to reasonable usage, technical, safety, or fair-use limits.

These limits help us maintain reliable service, control excessive automated use, prevent abuse, and manage the computational costs associated with AI-powered features.

Unless expressly stated otherwise, joining Bon Cheffy Club does not mean AI functionality is literally unlimited.

19. BON CHEFFY CLUB MEMBERSHIP PLANS AND BILLING

Bon Cheffy Club may be offered through automatically renewing membership plans.

Our initial membership options are:

Bon Cheffy Club Weekly

$6.99 USD per week

The membership renews weekly unless cancelled before the next renewal date.

Bon Cheffy Club Annual

$44.99 USD per year

The membership renews annually unless cancelled before the next renewal date.

Both plans include up to 4 recipe-generation requests per day, resetting at midnight UTC. Requests count when generation begins, including requests that subsequently fail. Unused daily requests do not roll over. Other AI features may have separate usage limits.

Prices shown above may vary by country, currency, taxes, app marketplace, promotional offer, or other factors.

The exact price charged to you will always be displayed before you confirm your purchase.

By purchasing Bon Cheffy Club, you authorize Bon Cheffy or the applicable payment provider to charge your selected payment method for the membership price, applicable taxes, and any other charges disclosed before purchase.

Bon Cheffy Club memberships may be processed by:

Apple App Store;
Google Play;
Stripe or another web payment processor; or
another payment provider identified at checkout.

Your membership will automatically renew at the applicable billing interval unless cancelled before renewal.

We may change Bon Cheffy Club pricing in the future.

Where required, we will provide advance notice of price changes and obtain any consent required by applicable law or app marketplace rules.

We may choose to preserve existing pricing for current members even if pricing changes for new members, but we are not required to do so unless applicable law provides otherwise.

20. CANCELLING BON CHEFFY CLUB

You may cancel your Bon Cheffy Club membership at any time.

Cancellation stops future automatic renewals.

Unless otherwise required by law, cancelling your membership does not immediately remove benefits you have already paid for. You will generally continue to have Bon Cheffy Club access through the end of your current paid billing period.

After that period ends, your account will generally return to Bon Cheffy Free unless you delete your account.

Deleting the Bon Cheffy application from your device does not cancel an active Bon Cheffy Club membership.

Apple App Store Memberships

If you purchased Bon Cheffy Club through Apple, you must generally manage or cancel your membership through your Apple subscription settings.

Google Play Memberships

If you purchased Bon Cheffy Club through Google Play, you must generally manage or cancel your membership through Google Play.

Direct or Web Memberships

If you purchased Bon Cheffy Club directly from Bon Cheffy, cancellation controls will be provided through your account, billing portal, or another reasonable method made available to you.

You are responsible for cancelling before your renewal date if you do not wish to be charged for another membership period.

21. REFUNDS AND BON CHEFFY MEMBER GUARANTEE

We want people to join Bon Cheffy Club because it makes cooking better—not because they feel trapped in a subscription.

Refund eligibility depends partly on where you purchased your membership.

Direct Bon Cheffy Purchases — 7-Day First-Purchase Guarantee

If your first paid Bon Cheffy Club membership was purchased directly from Bon Cheffy rather than through Apple or Google Play, you may request a refund within 7 calendar days of your first paid charge.

If approved under this guarantee, we will refund the applicable first membership charge to the original payment method.

This first-purchase guarantee applies once per customer unless we expressly state otherwise.

Direct Bon Cheffy Purchases — 48-Hour Renewal Courtesy

If a directly purchased Bon Cheffy Club membership renews unintentionally, you may contact us within 48 hours of the renewal charge and request a refund.

We may approve the refund where:

the request was made within 48 hours of renewal;
there has not been meaningful use of Bon Cheffy Club benefits following the renewal; and
the account is otherwise in good standing.

We reserve reasonable discretion to prevent fraud or repeated abuse of this courtesy policy.

Apple App Store Purchases

Purchases made through the Apple App Store are processed by Apple and are generally subject to Apple's refund procedures and policies.

Bon Cheffy does not control Apple's refund eligibility decisions and may be unable to issue a refund directly for a transaction processed by Apple.

Google Play Purchases

Purchases made through Google Play are subject to Google's applicable payment and refund procedures.

Depending on the timing and circumstances, Google may process the refund request directly or direct you to Bon Cheffy for further assistance.

Other Refund Circumstances

We may also provide refunds where appropriate for:

duplicate charges;
confirmed billing errors;
unauthorized transactions where legally appropriate;
technical errors that materially prevented access to a paid membership; or
circumstances where applicable law requires a refund.

Except as described above or required by law, Bon Cheffy Club charges are generally non-refundable and we do not ordinarily provide prorated refunds for unused portions of a billing period.

Nothing in these Terms limits any mandatory consumer refund, cancellation, or withdrawal rights that apply to you under applicable law.

22. FREE TRIALS, FOUNDING MEMBER OFFERS, AND PROMOTIONS

Bon Cheffy may offer free trials, promotional pricing, founding-member offers, referral benefits, limited-time discounts, or other Bon Cheffy Club promotions.

Annual Membership Trial

The Bon Cheffy Club Annual plan may include a 7-day free trial for eligible new members.

If you begin a free trial, you may receive access to Bon Cheffy Club features during the trial period without being charged the annual membership price immediately.

Unless you cancel before the trial ends, your membership will automatically convert to the paid Bon Cheffy Club Annual plan and the payment method associated with your account will be charged the annual membership price disclosed when you started the trial.

Trial eligibility may be limited to users who have not previously used a Bon Cheffy Club trial or membership promotion.

Removing the Bon Cheffy app from your device does not cancel a free trial.

You must cancel through the payment platform through which you started the trial.

Founding Member and Promotional Pricing

Bon Cheffy may occasionally offer special membership pricing to early adopters, founding members, community participants, referral recipients, partners, or users participating in specific promotions.

Promotional eligibility, duration, renewal pricing, and other conditions will be disclosed when the offer is presented.

A promotional price does not guarantee that the same price will remain available indefinitely unless the offer expressly states otherwise.

Changes to Offers

We may modify or discontinue promotional offers at any time, subject to applicable law.

Changes will not retroactively alter a paid membership period you have already purchased.

23. THIRD-PARTY SERVICES

Bon Cheffy may rely on third-party providers for functionality including:

artificial intelligence;
cloud hosting;
image recognition;
speech recognition;
text-to-speech;
analytics;
authentication;
payments;
social sharing; and
other infrastructure.

Your use of certain third-party services may be subject to their own terms and privacy policies.

We are not responsible for third-party websites, products, services, outages, or content that we do not control.

24. COPYRIGHT COMPLAINTS

Bon Cheffy respects intellectual-property rights.

If you believe content available through the Services infringes your copyright, you may send a copyright notice to:

Your notice should include:

identification of the copyrighted work;
identification and location of the allegedly infringing material;
your contact information;
a statement that you have a good-faith belief the use is unauthorized;
a statement that your notice is accurate and that you are authorized to act for the rights holder; and
your physical or electronic signature.

We may remove allegedly infringing material and may terminate repeat infringers where appropriate.

25. PRIVACY

Your privacy matters to us.

Our Privacy Notice explains how Bon Cheffy collects, uses, stores, processes, and shares personal information in connection with the Services.

The Privacy Notice forms part of your relationship with Bon Cheffy and should be reviewed before using the Services.

Where Bon Cheffy uses third-party AI, speech, cloud, analytics, or payment providers, information may be processed by those providers as described in our Privacy Notice.

26. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BON CHEFFY AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

WE DO NOT WARRANT THAT:

THE SERVICES WILL ALWAYS BE AVAILABLE;
BON CHEFFY WILL BE ERROR-FREE;
AI OUTPUT WILL BE ACCURATE;
RECIPES WILL PRODUCE A PARTICULAR RESULT;
FOOD IDENTIFICATION WILL BE CORRECT;
NUTRITION INFORMATION WILL BE ACCURATE;
VOICE RECOGNITION WILL BE CORRECT;
A FOOD ITEM IDENTIFIED IN AN IMAGE IS SAFE TO EAT;
ANY PARTICULAR INGREDIENT IS FREE FROM ALLERGENS; OR
THE SERVICES WILL MEET YOUR EXPECTATIONS.

YOUR USE OF BON CHEFFY IS AT YOUR OWN RISK.

27. NO MEDICAL OR PROFESSIONAL ADVICE

Bon Cheffy provides general cooking, entertainment, and informational content.

It does not provide:

medical advice;
medical diagnosis;
professional nutrition advice;
allergy diagnosis;
treatment recommendations; or
individualized healthcare advice.

Always seek appropriate professional advice regarding medical, dietary, allergy, or health concerns.

28. KITCHEN RISK

Cooking involves inherent risks including:

burns;
cuts;
fires;
allergic reactions;
foodborne illness;
hot surfaces;
boiling liquids;
sharp tools;
electrical appliances; and
other hazards.

You are responsible for using appropriate judgment and safety precautions while cooking.

Bon Cheffy is not responsible for injuries resulting from unsafe kitchen practices or failure to follow appropriate food-safety precautions, except where applicable law prohibits such limitation.

29. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BON CHEFFY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

THIS INCLUDES, WITHOUT LIMITATION:

LOSS OF DATA;
LOSS OF PROFITS;
LOSS OF BUSINESS;
DEVICE DAMAGE;
SERVICE INTERRUPTIONS;
PERSONAL INJURY ARISING FROM RELIANCE ON AI-GENERATED COOKING INFORMATION;
FOODBORNE ILLNESS;
ALLERGIC REACTIONS;
UNSUCCESSFUL RECIPES; OR
DAMAGES RESULTING FROM CONTENT YOU CHOOSE TO SHARE PUBLICLY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BON CHEFFY'S TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF:

(A) $100 USD; OR (B) THE AMOUNT YOU PAID TO BON CHEFFY DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain liability exclusions, so portions of this Section may not apply to you.

30. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bon Cheffy and its affiliates, officers, employees, contractors, and agents from claims, liabilities, losses, damages, and reasonable legal expenses arising from:

your User Content;
your violation of these Terms;
your violation of applicable law;
your violation of another person's rights; or
misuse of the Services through your account.

31. CHANGES TO BON CHEFFY

Bon Cheffy will continue to evolve.

We may modify, add, replace, suspend, or discontinue parts of the Services.

We do not guarantee that a particular feature will remain available indefinitely.

Where required by law, we will provide appropriate notice before making material changes that negatively affect paid Services.

32. CHANGES TO THESE TERMS

We may update these Terms from time to time.

If changes are material, we may notify you through:

the Bon Cheffy app;
email;
our website; or
another reasonable method.

The updated Terms will specify their effective date.

Continuing to use Bon Cheffy after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.

33. TERMINATION

You may stop using Bon Cheffy at any time.

You may also delete your account using available account controls or by contacting us.

We may suspend or terminate your access if:

you violate these Terms;
your use creates a security or legal risk;
payment is overdue;
your account is involved in fraud or abuse; or
continuation of the Services is no longer commercially or technically feasible.

Sections that by their nature should survive termination—including intellectual property, User Content licenses already necessary for lawful operations, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.

34. APP STORE TERMS

If you download Bon Cheffy through Apple App Store, Google Play, or another application marketplace, the marketplace provider is not responsible for operating or supporting Bon Cheffy except as required by its applicable platform terms or law.

Your use of Bon Cheffy must also comply with applicable marketplace rules.

For Apple-distributed versions of Bon Cheffy:

these Terms are between you and Bon Cheffy, not Apple;
Apple is not responsible for providing maintenance or support for the Services;
Apple is not responsible for claims relating to Bon Cheffy except where required by law;
Apple and its subsidiaries may be third-party beneficiaries of provisions applicable to Apple-distributed versions of the app.

35. GOVERNING LAW

These Terms are governed by the laws of Illinois, without regard to conflict-of-law principles, except where consumer-protection laws in your jurisdiction require otherwise.

Any dispute not otherwise resolved between you and Bon Cheffy will be brought in the state or federal courts located in Cook County, Illinois, and you and Bon Cheffy consent to the jurisdiction of those courts.

Nothing in this Section prevents you from exercising mandatory rights available under applicable consumer law.

36. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted and the remaining provisions will remain in effect.

37. NO WAIVER

If Bon Cheffy does not enforce a provision of these Terms in a particular instance, that does not mean we waive our right to enforce it later.

38. ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written permission.

We may transfer these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar transaction.

39. ENTIRE AGREEMENT

These Terms, together with our Privacy Notice and any additional terms presented for specific Services or purchases, constitute the agreement between you and Bon Cheffy regarding the Services.

They supersede prior agreements relating to the same subject matter.
